We consider Automatic Networking Solutions Pty. Ltd. to be a spam-unfriendly company.
Reports of breaches of our TOS may be made by sending an email to abuse@autons.net.au. Please ensure your complaints are accompanied by full headers so we can verify that our client (or their customers) are indeed to blame.
These Terms of Service were last modified on 2008-04-19.
1. Definitions
1.0: We use the following definitions in this document:
- Client/s, You: People and/or organisations who we supply services to.
- Customer/s: People and/or organisations who our clients supply services to.
- AutoNS, We, Us: Automatic Networking Solutions Pty. Ltd. (ACN 099822965).
- Spam: 'direct marketing by email' and 'opt-out mailing lists' are synonymous with the word 'spam' here. 'Opt-in mailing lists' may also be 'spam' if the recipients had no idea they were opting into receiving communication from this particular sender. On Usenet, spam is any posted material which breaches a newsgroup charter and any unwelcome advertising material posted to a newsgroup without a charter.
2. Responsibilities
2.1: Clients must at all times:
- Be at least 18 years old and legally able to sign and agree to contracts.
- Never make a person under the age of 18 a contact person for an account.
- Always ensure that their contact details are correct.
- Make payments by the Due Date. Expired accounts will have their services halted.
- Remain aware of changes, which may occur from time to time, to these Terms Of Service.
- Never transmit any material that could constitute a criminal offense, violate a third party's copyright, give rise to civil liability or otherwise violate any applicable law or regulation.
- Never attempt to gain unauthorized access to, interfere with or disrupt, other computer systems, routers or appliances attached to this network or other networks.
- Correctly identify themselves.
2.1.1: MX (Mail Exchange) and WAIX Usenet clients further agree:
- Not to use the service to send spam or receive contact email resulting from spam activities.
- Not to transmit through the Service any harassing, libelous, abusive, threatening or harmful material of any kind or nature.
- Not to set an AutoNS system to be the highest preferenced mail (MX) server instead of your own.
2.1.2: WAIX Usenet and WAIX IP Checking clients further agree:
- Any Usenet or WAIX IP Checking services provided may not be resold or otherwise transferred to third parties.
2.2: AutoNS agrees to promptly:
- Provide prior notification of disruption to services where we ourselves have been given notice.
- Inform customers of any other disruption to the service as soon as possible.
- Provide consise technical support for our services.
- Provide easy access to itemised Tax Receipts.
- Effectively respond to any billing issues and refund quickly if warranted.
- Contact the client whenever considering whether they have breached these Terms Of Service.
3. Legal matters
3.0: The client agrees to indemnify AutoNS (including its parents, subsidiaries, affiliates, officers and employees) from any third party claim due to the use of services provided, the violation of this TOS by the client (or the client's customers).
3.1: As the Internet continues to become regulated by the Australian government, AutoNS must comply with any legal authorised request from government departments.
3.2: The services AutoNS provides are services and are not transferable property.
3.3: Computer software we resell through the site may be governed by their own licenses.
3.4: This agreement was entered into in Perth, Western Australia, and shall be governed by the prevailing laws here.
3.5: While clients may purchase some types of services which they then provide to their own customers, the business relationship always remains between the client and AutoNS alone.
4. Sunset
4.0: Services hosted with us may be removed at our discretion where these Terms of Service have been broken. When a final decision occurs:
- No refunds will be given. Any residual moneys after the first AUD $250 will be donated to charity (Oxfam Community Aid Abroad).
- Clients will be given 5 working days notice before services cease and account removal (except in the case of ongoing spam in which case services will be disabled immediately).
- AutoNS may inform third parties (eg, complainants, upstream providers, etc) of any decisions made to remove an account or disable services.
4.2: The client may terminate the Service without cause at any time and effective immediately, via the website's interface. A refund will not be owed to the client if the client chooses to close their account in this manner.
4.3: Upon termination of their account, the client's right to use their account and services of this company immediately ceases. The client shall have no right and AutoNS will have no obligation thereafter to provide services to the client or any third party.
